Terms & Conditions

Booking Conditions: Reservations should be made well in advance by calling Exclusive Tours or your travel agent. A deposit is required at the time of reservation. Deposits will vary and the exact amount required will be quoted at time of booking, and are detailed per supplier/product below and on the following pages. If airfare and/or land packages are also booked, there may be an additional deposit required. Written confirmation stating this and the final payment due date will be sent once the deposit has been received. In the case of billing errors we reserve the right to re-invoice with correct pricing. Final payments are due in our office no later than 100 days prior to departure date.

Cancellations and Refunds: Cancellations are only considered to have been received on the date of receipt of written cancellation in the offices of Exclusive Tours. Cancellation penalties vary with suppliers, and are outlined below and on the following pages.

2009/2010 Terms & Conditions of sale for FLIGHTS booked by Exclusive Tours, priced in Canadian dollars

A minimum deposit of CDN $400/person is required. For some itineraries, full payment will be due immediately. Please note flight prices may be subject to fuel surcharges or other changes up to time of ticketing. Should airlines require earlier payment than due date shown on invoice, we will notify you. Written confirmation stating this, and the final payment due date, will be sent once deposit has been received. In the case of billing errors, we reserve the right to re-invoice with correct pricing. Final Payments are due in our office no later than 100 days prior to departure date. For cancellations received prior to departure for:

There is no refund for unused services or if portions of the booked services are missed. Some flights may also have a different cancellation policy. This will be stated when confirmation is given, if different.

Revision fee:A modest $60 CDN revision fee per revision is charged for any changes made to a reservation after the written confirmation was sent. For all reservations, please use the names of the travelers exactly as they appear on their passports. A change in name or flight date after ticket is issued may constitute a cancellation, and cancellation penalties may apply.

2009/2010 Amadeus Waterways/AMA Waterways Cruises Terms & Conditions

Amadeus Waterways/AMA Waterways cruises and cruise-tours priced in US dollars, deposit required is $500 US/person per cruise; if priced in Canadian dollars require deposit of $600 CDN/person per cruise.

Cancellations and Refunds: Cancellations are only considered to have been received on the date of receipt of written cancellation in the offices of Exclusive Tours.

2009/2010 Blount Small Ship Adventures Terms & Conditions

2009/2010 China Cruise-Tours & Luftner River Cruises Terms & Conditions

China Cruise Tours & Luftner cruises require a deposit of 15% of the total cruise fare at time of booking. Written confirmation stating this, and the final payment due date, will be sent once the deposit has been received. In the case of billing errors we reserve the right to re-invoice with correct pricing. Final payments are due in our office no later than 130 days prior to departure date.

Cancellations and Refunds: Cancellations are only considered to have been received on the date of receipt of written cancellation in the offices of Exclusive Tours.

For cancellations received prior to departure for China Cruise-Tours & Luftner River Cruises:

2009/2010 Scenic Tours Terms & Conditions

Scenic Tours cruises, cruise-tours and tours priced in Canadian or US dollars require deposit of $500 CDN/$500 USD person per cruise. Balance is due 100 days prior to departure.

Cancellations and Refunds: Cancellations are only considered to have been received on the date of receipt of written cancellation in the offices of Exclusive Tours.

For cancellations received prior to departure for Scenic Tours cruises, cruise-tours, and tours:

La Compagnie du Ponant cruises priced in Canadian dollars require deposit of $700 CDN/person per cruise; if priced in US dollars, deposit required is $600 US/person per cruise.
Written confirmation stating this, and the final payment due date, will be sent once the deposit has been received. In the case of billing errors we reserve the right to re-invoice with correct pricing. Final payments are due in our office no later than 100 days prior to departure date.

2009/2010 Voyages of Discovery Cruises on MV Discovery Terms & Conditions

VOD Terms & Conditions

The following provisions apply to the booking of your Voyages of Discovery cruise, cruise-tour or travel package on MV Discovery and are the terms and conditions that apply upon the acceptance of your deposit by Exclusive Tours. They also cover the company’s air travel arrangements made as part of your cruise and the land tour packages with cruises offered by Voyages of Discovery.

Voyages of Discovery cruises are priced in US dollars, and require initial deposit within 3 days of reservation of US $600/CAD $700 per person per cruise. A second deposit of US $600/CAD $700 per person, per cruise is required 120 days prior to the scheduled sailing date. Written confirmation stating this and the final payment due date will be sent once the initial deposit has been received. In the case of billing errors we reserve the right to re-invoice with correct pricing. The balance is due no later than 100 days prior to sailing, together with passport details and dining room requests. Passengers who do not make second deposits or final payments at appropriate times may be subject to cancellation without notice.

Cancellations and Refunds: Cancellations are only considered to have been received on the date of receipt of written cancellation in the offices of Exclusive Tours.

When booking a “Double Early Booking Discount:” or a “Canadian Dollars at Par” promotion, as indicated at time of booking (check “Notes” on invoice) the deposit is non-refundable. Otherwise, for cancellations received prior to departure for Voyages of Discovery:

TERMS AND CONDITIONS FOR SWAN’S DISCOVERY CRUISES & SWAN’S RIVER CRUISES

For Swan’s Discovery Cruises and/or Swan’s River Cruises Exclusive Tours requires a non-refundable initial deposit at the time of booking of USD $500/CAD$650 per person per cruise or 10% of the cruise fare (whichever is higher). Balance of payment is due 100 days prior to the scheduled sailing date of the first cruise. Written confirmation stating this and the final payment due date will be sent once the initial deposit has been received. In the case of billing errors we reserve the right to re-invoice with correct pricing. The balance is due no later than 100 days prior to sailing, together with passport details and dining room requests. Passengers who do not make final payments at appropriate time may be subject to cancellation without notice.

For cancellations received prior to departure for Swan’s Discovery Cruises and/or Swan’s River Cruises, Cancellation charges are:

2009/2010 European Waterways Terms & Conditions

For individual bookings (as opposed to whole-boat charters)
Barge Cruises: priced in Canadian dollars require a deposit of $1,300 CDN per person per cruise; if priced in US dollars deposit required is $1,100 US per person per cruise.

Written confirmation stating this, and the final payment due date, will be sent once the deposit has been received. In the case of billing errors we reserve the right to re-invoice with correct pricing. Final payments are due in our office no later than 100 days prior to departure date.

Cancellations and Refunds:Cancellations are only considered to have been received on the date of receipt of written cancellation in the offices of Exclusive Tours.

For cancellations of individual bookings received prior to departure for European Waterways cruises:

For whole-boat charters of European Waterways barges: Deposit of 30% of the full fare charter is required at time of booking. The difference between the initial deposit and 30% of total price is required 180 days prior to departure. The remainder of the charter or group price is due 130 days prior to departure.

To qualify for the charter group rate, one person must act as tour leader and be responsible for contracting with and making all payments to Exclusive Tours, as per the Terms and Conditions, on behalf of all passengers in the charter/group.

Cancellations of charter bookings of European Waterways barges:Charter deposits are not refundable. Up to 180 days prior to departure, deposits may be applied toward individual bookings on the same vessel in the same year, subject to a CDN$600/US$500 surcharge per passenger. Cancellations 180-130 days prior to departure, the full 30% deposit will be retained. Cancellations 129 to zero days prior to departure will receive no refund. Changes of any kind may be subject to a CDN$250/US$150 surcharge per passenger. Reductions in passenger number on charters are only accepted up to 130 days prior to departure. No refunds will be given in the event of interruption or cancellation of the cruise by the Passenger after start of travel, nor for any unused portion of any package or cruise, nor for any unused sightseeing tours or meals.

2009/2010 Polar Star Expeditions Terms & Conditions

Cruises priced in Canadian dollars require deposit of $800 CDN/person per cruise; if priced in US dollars, deposit required is $600 US/person per cruise.
Written confirmation stating this, and the final payment due date, will be sent once the deposit has been received. Passenger must provide completed medical forms at time of confirmed booking. In the case of billing errors we reserve the right to re-invoice with correct pricing. Final payments are due in our office no later than 100 days prior to departure date.

Cancellations and Refunds:Cancellations are only considered to have been received on the date of receipt of written cancellation in the offices of Exclusive Tours.

For cancellations received prior to departure for Polar Star Expeditions:

For Voyages of Antiquity, Exclusive Tours requires a 10% of the cruise fare within 7 days of booking or sooner as noted on your confirmation invoice.Balance of payment is due 90 days prior to the scheduled sailing date of the first cruise. Written confirmation stating this and the final payment due date will be sent once the initial deposit has been received. In the case of billing errors we reserve the right to re-invoice with correct pricing. The balance is due no later than 90 days prior to sailing, together with passport details and dining room requests. Passengers who do not make final payments at appropriate time may be subject to cancellation without notice.

General Terms & Conditions Apply for All Exclusive Tours' Suppliers

* “Full fare” includes cruise, port & service fees, land & flight arrangements, including departure taxes and any and all other items on the passenger invoice. There is no refund for unused services or if portions of the cruise or tour are missed. Some flight and land arrangements may also have a different cancellation policy. This will be stated when confirmation is given, if different. Note: there will be no refund for days missed on tour.

For air-inclusive reservations, please use the names of the travelers exactly as they appear on their passports. A change in name or departure date may constitute a cancellation, and penalties may apply.

Insurance: Trip cancellation, medical and hospital, baggage, and various additional coverages are strongly recommended and are available at the time of booking your vacation. Please speak with our representative or your travel agent at the time of making your reservation.

Personal Documentation: All passengers must travel with a passport valid for at least 6 months after the return date of the trip. Visas may be required for some destinations – please check with your travel agent or Exclusive Tours. It is the passenger's responsibility to obtain at the passenger's expense, all documentation required by all relevant authorities. In the event that the passenger does not possess the documentation, the carrier reserves the right to refuse passage. It is absolutely necessary for the travel agent to be aware of the citizenship/nationality of all members of a traveling party to ensure that they provide correct information regarding documentation.

Tour documents: A tour document packet is sent two to three weeks prior to your departure. If you request documents earlier there is a $65 CAD/$50 USD handling charge to cover the extra costs of early processing. If a reservation is made within three weeks of departure, a late booking fee of $65 CAD/$50 USD may be assessed to facilitate RUSH documentation.

Prices: Prices on our website or in our Exclusive Tours brochures are for the most part per person, based on two persons sharing a room, and are in effect at the time of printing or loading and are subject to change without notice. No price increases are permitted after the customer has paid in full. If the price increase is more than 7% (except for increases resulting from an increase in retail sales tax or federal Goods and Services Tax), the customer has the right to cancel the contract and obtain a full refund.

Tips on cruise and land tours: Gratuities are not included and are customary, subject to your satisfaction with the services received. Tips to local guides during the sightseeing and shore excursions are also not included and are customary. These will vary, but to give you a guideline, might we recommend – River Cruises – 10-15 Euros per person per day for the cruise, and for the guides 1-2 Euros for a half-day tour and 2-4 Euros for a full-day tour.

Itinerary changes: Although every effort will be made to keep itineraries and hotels as they are shown in the brochure, our suppliers reserve the right to substitute itineraries, hotels or vessels due to conditions beyond their control. In such cases, they will do everything possible to ensure that the locations visited, the excursions taken and the hotels offered are similar to the ones originally planned. Any change to itineraries will not result in eligibility for a refund.

Advanced, Cancelled or Delayed Sailing: Our suppliers reserve the right to cancel, advance or postpone any scheduled tour and/or sailing date and may, but are not obligated to, substitute another vessel. Exclusive Tours and our suppliers will not be liable for any loss to you by reason of any such cancellation, advancement or postponement. In the event of cancellation by one of our suppliers, your sole right of recourse shall be to obtain a refund of monies paid to Exclusive Tours in connection with such tour.
Note: Hotel rooms are only available for check in after 1 PM.

Not included in the tour price: Cost of passport, visas, excess baggage charges, air departure taxes, items of a personal nature, drinks & beverages (except where stated herein) and items not listed in the inclusions as stated herein.

Responsibility: Exclusive Tours (hereinafter referred to as ET) is a division of Merit Specialty Vacations, Inc. ET and/or their agents act solely as agents for the Travel Service Suppliers such as cruise lines, luxury barge operators, airlines, hotels, etc. who are providing their facilities as described in this brochure. We do our best to select such suppliers but exercise no control over them and cannot be held responsible for the failure of these suppliers to carry out any obligations. Any and all bookings made with these suppliers by us, for you, are subject to the terms and conditions of each and every such supplier. Suppliers' liability may also be limited by law, tariffs, or conditions set forth in their documentation, tickets, etc. Without limiting the generality of the foregoing, ET and its agents are not responsible for any and all claims for losses, damages, delays, illness, injuries, inconvenience, loss of enjoyment, or anxiety arising from: a) Fault of negligence or omissions on the part of said travel suppliers. b) Illness, theft, strikes, mechanical problems, quarantine, governmental intervention, weather conditions, acts of hostility or violence and any other grounds beyond their control; c) Your failure to obtain passport, visas, inoculations or other travel documents; d) Your failure to report on time at an airport or ground transfer facility; e) Material damages, theft or other mysterious disappearance of your goods; f ) Personal injury or death; g) Force Majeure – event(s) beyond our, or our suppliers' reasonable control including, but not limited to, acts of God, strikes, lockout or other labour disputes or disruptions, wars, blockades, insurrections, riots, earthquakes, weather conditions, floods or acts or restraints imposed by governmental authorities. Liability: Where travel services are purchased separately, and not as part of an inclusive package, Exclusive Tours/Merit Specialty Vacations Inc.'s responsibility shall extend only to the provisions of advice as to industry-standard or supplier recommended, connection and check-in times. Provided Merit Specialty Vacations Inc. supplies such advice, it shall not be responsible for missed connections or departures, regardless of the cause.
